Discount Fence Supply, Inc. warrants to the original homeowner/consumer that it's Vinyl products purchased, installed and/or utilized in the continental United States of America and Canada will be free from anufacturing defects as defined in the Lifetime Warranty subject to all the following conditions:
1. If during the lifetime of the original purchaser (and as long as the original purchaser is still living and retains ownership of the property) following installation of the Vinyl Railing and posts said product manifests signs of splitting, racking, surface peeling, discoloration, rot, termite attack and/or corrosion and if, after examination upon receipt by manufacturer of the alleged defective product, freight prepaid by Discount Fence Supply, Inc. it is determined by Discount Fence Supply, Inc. that the splitting, cracking, surface peeling, discoloration, rot, termite attack and/or corrosion is caused by, or results from, defective manufacture of the Vinyl Railing and posts, then, in its sole discretion, Discount Fence Supply, Inc. agrees to either refund or replace the defective material. If Discount Fence Supply, Inc. chooses to refund, the amount will be the original cost of the material only and will not include any installation costs. If Discount Fence Supply, Inc. chooses to replace the defective material, Discount Fence Supply, Inc. will provide only identical or equivalent material at no cost to you and will not include or reimburse installation costs.
2. The lifetime coverage offered by this warranty automatically ends upon the sale of the property or death of the last of the original owners of the property at the time of installation.
3. Discount Fence Supply, Inc. Lifetime Warranty expressly excludes the following:
A. Unsatisfactory Vinyl Railing and posts performance including splitting, cracking, surface peeling, rot, termite attack and/or corrosion caused by or resulting from failure to comply with Discount Fence Supply, Inc. installation instructions and/or otherwise resulting from faulty installation of the Vinyl Railing and posts and/or
B. Vinyl Railing and posts failure, including splitting, cracking, surface peeling, rot, termite attack and/or corrosion due to impact from any failure or unsatisfactory performance resulting from misuse of or failure to maintain the Vinyl Railing
and posts and any damage attributable to fire or other casualty, including, without limitation, acts of God, or exposure to environmental pollutants and/or
C. Vinyl Railing and posts failure, including splitting, cracking, surface peeling, rot, termite attack and/or corrosion resulting from movement and/or collapse of the ground or structure on which the Vinyl Railing and posts is installed and/or
D. Fading of original color due to misuse or conditions not associated with natural weathering processes.
4. Discount Fence Supply, Inc. Lifetime Warranty is void if the Vinyl Railing and posts is purchased, installed and/or utilized
outside the United States of America or Canada. 5. Discount Fence Supply, Inc. warrants only those products manufactured or fabricated by it REGISTRATION AND CLAIM PROCEDURE
A. All claims of alleged Vinyl Railing and posts defects shall be submitted in writing within thirty (30) days of discovery of such alleged defect. Claims shall be addressed to Discount Fence Supply, Inc., PO Box 185, New Holland, Pennsylvania 17557.
B. No warranty claims shall be honored without presentation of this written contract. Railing and posts Lifetime Warranty and submission of "Certificate of Installation" by the original purchaser and owner of the property on which the Vinyl Railing and posts is installed. This warranty and the rights created herein are not transferable by the original Purchaser of Vinyl Railing and posts.
THIS WARRANTY STATES THE ENTIRE LIABILTY OF Discount Fence Supply, INC. WITH RESPECT TO
THE PRODUCTS NAMED ABOVE. ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR USE IS SPECIFICALLY EXCLUDED AND DISCLAIMED BY Discount Fence Supply, INC.
UNDER NO CIRCUMSTANCES WILL Discount Fence Supply, INC. BE RESPONSIBLE FOR INCIDENTAL
OR CONSEQUENTIAL DAMAGES ARISING OUT OF NEGLIGENCE, BREACH OF THIS WARRANTY, OR ANY
IMPLIED WARRANTY, AND SUCH DAMAGES ARE SPECIFICALLY EXCLUDED FROM THIS WARRANTY.
